Heard learned counsel for the petitioner, learned State counsel for opposite party Nos. 1, 2 & 4 and Sri S. S. Rajawat, learned counsel for opposite party No.3 i.e. Basic Education Officer, Sultanpur.

In view of order being passed, notice to opposite party No.5 stands dispensed with.

Petition has been filed seeking a direction to the concerned authority to correct date of birth mentioned in the transfer certificate of class-VIII of the petitioner issued by the Delhi Montessori School, Sultanpur by recording the correct date of birth as 10 June, 2010 instead of 10 June, 2011.

Learned counsel for the petitioner submits that an application for such correction has been filed by the petitioner before the school concerned. It is submitted upon instructions that the school is refusing to make such a correction until and unless the Basic Education Officer issues any such direction. Learned counsel has drawn attention to the school leaving certificate to submit that the same has been counter signed by Block Education Officer, who therefore has role in such correction.

It has also been submitted by the counsel for the petitioner that once the initial copies of the hospital record pertaining to date of birth of petitioner was made available before the school concerned, it was incumbent upon them to have considered the same.

Learned counsel appearing for opposite parties have repeated submissions advanced by learned counsel for the petitioner with the submission that his grievance is primarily with the private school concerned. It is submitted that for the purposes of correction of date of birth as entered in the school records at the time of admission of student, there is no role of either the Basic

Education Officer or the Block Education Officer concerned and it is solely the prerogative of the school concerned to correct date of birth on evidence on which it may place reliance. It is also submitted that the school leaving certificate is counter singed by the Block Education Officer only on the basis of initial entry of date of birth made in the records of school.

In view of such submission being advanced by learned counsel for the opposite parties, particularly, the Basic Education Officer and the Block Education Officer that they do not have any role in correction of date of birth, liberty is granted to the petitioner to pursue his application for correction of date of birth initially recorded in school records, which may be considered expeditiously by the school concerned.

With the aforesaid directions, petition stands disposed of.
