Heard Sri Rahul Agarwal, learned counsel for the petitioners. Learned Standing Counsel has accepted notice on behalf of respondents no.1 & 2 and Sri R. K. Ojha, learned Senior Counsel assisted by Sri Shivendu Ojha, learned counsel for the respondent no.3.

The petitioners have preferred present writ petition inter-alia with the following prayers :-

"i. Issue a writ, order or direction in the nature of Certiorari calling for the records of the case and to quash the impugned order dated 30.04.2024 passed by the District Inspector of Schools, Prayagraj/respondent No.2 (Annexure no.1 to this writ petition)."

By the aforesaid order, District Inspector of Schools, Prayagraj attested the signature of the respondent no.3-Shri Jeet Lal Saroj to work on the post of officiating Principal on 30.04.2024.

It is argued by counsel for the petitioners that the enquiry initiated against the respondent no.3 namely Jeet Lal Saroj has been concluded and thereafter a resolution to terminate his services has been passed by the Management on 04.8.2024 and the papers and documents in this regard has been forwarded by the Management to the District Inspector of Schools, Prayagraj on 12.08.2024. It is argued that till date no decision has been taken on the same.

Heard learned counsel for the parties and perused the records.

With the consent of learned counsel for the parties, present writ petition is disposed of finally directing the respondent no.2 namely District Inspector of Schools, Prayagraj to pass appropriate orders on the resolution of the Management within a period of six weeks

from today.

The functioning of the respondent no.3 will be continue till the time decision is taken by the respondent no.2 in the matter.

Registrar (Compliance) is directed to communicate copy of this order to the respondent no.2 namely District Inspector of Schools, Prayagraj within three days from today.
