Heard learned counsel for petitioner, learned State Counsel for opposite party nos. 3 & 4 and Mr. Dilip Kumar Pandey, learned counsel for opposite party no. 1. In view of order being passed, notice to opposite party no. 2 stands dispensed with.
Petition has been filed seeking a writ in the nature of certiorarified mandamus for quashing the order dated 06.09.2023.
Learned counsel for opposite parties have raised a preliminary objection that the order dated 06.09.2023 is only a communication of the proposal of the Gram Panchayat dated 29.08.2023 whereby petitioner was removed from service, which however is not under challenge.
In view of such an objection being raised, learned counsel for petitioner seeks to withdraw this petition with liberty to file afresh.
In view of such submission, the petition is dismissed as withdrawn granting the aforesaid liberty.
