Heard learned counsel for petitioner, learned State Counsel for opposite party nos. 1, 2 & 4 and Mr. Varun Pandey, learned counsel for opposite party no. 3. In view of order being passed, notice to opposite party no. 5 stands dispensed with.

Petition has been filed seeking following relief:-

"A. Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to take steps under section-21 of Contract Labour (Regulation and Abolition) Act, 1970 for payment of petitioner's salary/wages for the period of 01.09.2020 to 24.03.2021 worked by the petitioner as contract labour on the post of Quantity Surveyor in the project of "Construction Of Viaduct & its Approaches to ROB At KM 426 Of NH-91 in Kanpur City On EPC Mode in Uttar Pradesh" under the opposite party nos. 2 to 4 being engaged by the contractor the opposite party no. 5 and to release the payment along with interest applicable at market rate to be compounded periodically from the due date till the date of actual payment, within a short reasonable period to be prescribed by this Hon'ble Court in the interest of Justice."

Since consideration of petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file a fresh representation before opposite party no. 2 i.e. Chief Engineer (National Highways) Uttar Pradesh Public Works Departments, Lucknow or any other competent authority which shall be considered and decided within a period of eight weeks from the date a certified copy of this order is produced before the said authority.

With aforesaid observations and directions, the petition is finally disposed of .
