Heard learned counsel for petitioner, learned State Counsel for opposite party No.1 and Mr. Ranvijay Singh learned counsel for opposite party No.2 who has raised a preliminary objection regarding maintainability of this petition on the ground that petitioner is seeking inclusion of his name in the select list for appointment on the post of Assistant Teacher without challenging the same nor even impleading some of the selectee in the representative capacity. It is submitted that the petition is also bad for non joinder of necessary parties since the Basic Education Officer concerned have not been impleaded.
Considering aforesaid objections, learned counsel for petitioner seeks to withdraw this petition with liberty to file afresh.
In view of aforesaid, petition is dismissed as withdrawn with aforesaid liberty.
