Heard learned counsel for petitioner, learned State Counsel appearing on behalf of opposite parties no.1 and 2 and Mr. Saurabh Singh, Advocate holding brief on behalf of Mr. S.S. Rajawat, learned counsel for opposite parties no.3 and 4.

Petition has been filed seeking a direction to opposite parties for payment of family pension, arrears with effect from January, 2006 to November, 2012.

For the aforesaid grievance, petitioner has already submitted a representation but seeks liberty to file fresh representation before competent authority. At present learned counsel for petitioner restricts his prayer for a final decision with regard to same.

Considering innocuous prayer being made by learned counsel for petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No.3 i.e. Basic Shiksha Adhikari, Amethi. In case such a representation is filed, the same shall be considered and decided within a period of six weeks from the date a certified copy of this order is produced before the said authority. In case petitioner is found entitled for the aforesaid benefits, actual payment of same shall also be ensured within a period of six weeks thereafter.
