In pursuance to previous order passed by this Court, the Director, Employee State Insurance Scheme Labour Medical Services, Sarvodaya Nagar, Kanpur has filed an affidavit of compliance stating that the order passed by the Writ Court has been complied by the opposite party. The same is taken on record.

It has been stated in paragraph-4 of the affidavit that the amount relating to arrears of A.C.P., arrears of pay and leave encashment have been credited in the account of the applicant/petitioner on 29.07.2024. It has been further stated in the affidavit that so far as the payment of pension and gratuity is concerned, after approval by the D.D.O., the same has been forwarded to the Additional/Joint Director, Pension, Mirzapur Division, Mirzapur, who has passed orders directing the Chief/Senior Treasury Officer, Mirzapur vide P.P.O. dated 30.07.2024 for payment of pension and the same shall be credited in the account of the applicant/petitioner after completion of necessary formalities. It has also been stated that the payment of G.I.S. and G.P.F. had already been made in the year 2021.

The details regarding amount involved in the aforesaid heads have been given in paragraphs-4, 5 & 6 of compliance affidavit.

In view of the fact that the order passed by the Writ Court has been complied by the opposite party, no further orders are required to be passed in the present application.

The application is disposed of and consigned to records. Notice issued to the opposite party is discharged.

It is clarified that in case of any future non compliance or if the amount referred above is not credited in the account of applicant within three weeks from today, the applicant shall be at liberty to file recall application for recall of the present order.
