Sri Devendra Mohan Singh, learned counsel for the applicant and Sri Sanjay Kumar Singh, learned A.G.A. for the State are present.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the order dated 18.05.2024 passed by Additional Chief Judicial Magistrate, Court No. 10, Azamgarh as well as charge sheet dated 25.09.2022, arising out of Case Crime No. 237 of 2021, under Sections 457, 380, 504, 506, 386, 34, 120-B and 352 IPC, P. S. Kotwali, District Azamgarh, whereby an application under Section 239 Cr.P.C. for discharge has been rejected.
After some arguments, learned counsel for the applicant does not want to press the application and wants liberty to file a appropriate application before the court of competent jurisdiction.
Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
