Present application under Section 482, Cr.P.C. has been filed by the applicant to quash the order dated 5.6.2024 passed by Additional Sessions Judge/F.T.C.-1st, Kannauj in Session Trial No. 145 of 2018 (State Vs. Vikash @ Kala Bachacha), arising out of case crime No. 125 of 2019, under Sections 376, 452, 323, 506, I.P.C., Police Station Thathiya, District Kannauj, whereby the application under Section 311, Cr.P.C. has been rejected.
Learned counsel for the applicant fairly admits that in application under Section 311, Cr.P.C., no question has been asked from the P.W.-1, as mentioned.
After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction along with the questions, which were not asked from the P.W.-1.
The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
Office shall return the certified copy of the documents to the learned counsel for the applicant, after retaining a xerox of the same.
