Heard learned counsel for petitioner, learned State Counsel appearing on behalf of opposite party no.1 and Mr. Prashant Kumar Singh, learned counsel for opposite parties no.2 to 4.

Petition has been filed seeking a direction to opposite parties to consider petitioner's case for appointment in lieu of acquisition of his father's agricultural property bearing Gata No.1931 and 1966 situated at Village Shiv Nathpur, ParganaKhandasa, Tehsil- Milkipur, District Faizabad/ Ayodhya.

Learned counsel for opposite parties however submits that there is no provision under law whereby such a substantive right would accrue to petitioner. It is submitted that earlier scheme providing such employment in view of acquisition of property has been struck down by Full Bench decision of this Court in the case of Rabindra Kumar versus District Magistrate, Agra & Anr. reported in 2004 (4) ESC Allahabad 2354.

Upon consideration of submissions advanced by learned counsel for parties and perusal of material available on record, it is quite evident that there does not appear to be any scheme under which such an appointment could be provided to petitioner also particularly in view of the Full Bench decision of this Court as indicated hereinabove.

Considering the aforesaid facts and law, petition being devoid of merit is dismissed . Parties to bear their own costs.
