Heard learned counsel for the petitioner, learned counsel for respondentUniversity and learned Standing counsel for the State.
The present petition has been filed with the main prayer:-
"(iii) issue a writ, order or direction in the nature of mandamus commanding the respondent no. 3 to decide and consider the claim of the petitioners in respect of making self-centre/allotment of their college (respondent no. 4) in their forthcoming examinations."
It is submitted by learned counsel for the petitioners that the petitioners being girl students should be provided their own Institute as Examination Centre. It is next submitted that the examination of petitioner no. 1 is scheduled to be held on 20.1.2023.
Learned counsel for respondent-University contends that in the facts of the present case, no useful purpose would be served in keeping the writ petition pending and an appropriate direction be issued to respondent no. 3 to look into the grievance of the petitioners.
In view of the submission advanced by the learned counsel for the petitioner and considering the facts of the case, this Court is of the opinion that the petitioner may be permitted to file a fresh representation raising all his grievances before respondent no.3-Controller of Examination, Chatrapati Shahu Ji Maharaj University, Kanpur, within 24 hours along with a copy of this order.
In case any such representation is filed by the petitioner, the respondent no.3 shall decide the same by reasoned and speaking order within a period of 24 hours thereafter, after giving opportunity of hearing to all the concerned parties, in accordance with law.
With the aforesaid observations, the writ petition is disposed of.
