Heard Shri Ajay Mishra, Advocate holding brief of Shri Shri Krishna Mishra, learned Counsel for the petitioner, learned Standing Counsel for respondent nos.1 to 3.

The instant writ petition under Article 226 of the Constitution of India has been filed by the Committee of Management C.L.M. Inter College, Jani Meerut through its Manager for direction to the respondent no.3, District Inspector of schools, Meerut to take decision on the application dated 30.10.2022 and 12.10.2021 and grant permission to the petitioner, Institution to fill up Class IV post in the Institution.

Learned Standing Counsel on the basis of instructions dated 13.04.2022 received from District Inspector of Schools submits that in view of judgement of the Apex Court dated 27th September, 2021 passed in Civil Appeal No.865 of 2021 the vacancy of Class IV employee in the Institution has to be filled up through proper implementation of the "Outsourcing" through some agency and for that purpose no permission from the District Inspector of Schools is required.

Learned Counsel for the petitioner admitted the said position and submits that in view of aforesaid, the prayer made in the writ petition has been fulfilled, hence, this writ petition may be dismissed.

The writ petition is, accordingly, dismissed.

The instructions dated 13.04.2022 received from the District Inspector of Schools, Meerut be taken on record.
