Heard Sri Raghvendra Yadav, learned counsel for the petitioners, learned Standing Counsel for the respondents-1, 2 & 4, Sri Shrestha Pratap Singh, holding brief of Smt. Archana Singh, learned counsel for the respondent-3 and perused the record.
Present writ petition under Article 226 of the Constitution has been filed for following reliefs:
"(i) Issue a writ, order or direction in the nature of certiorari quashing/cancelling the impugned UPTET-2021 examinations (Primary and Upper Primary Levels) held on 23.01.2022 in pursuance of Government Order No-15/2021/1103/sixty eight-4-2021-9(16)/2020 dated 22.12.2021 (Annexure No. 9 to the writ petition)
(ii) Issue a writ, order or direction in the nature of mandamus commanding the respondent authorities to conduct a fresh and fair examination of UPTET-2021 expeditiously as per law and make sure the aspirants would not be made to pay any charges for the same.
(iii) Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 1 to set up a high power committee to fix the responsibility of the concerned who has/have committed this wilful mistake so that these types of the acts would not be repeated in the future. "
It is submitted by learned counsel for the petitioners that the petitioners appeared in UPTET-2021 and the result of the said examination was declared in the month of April, 2022, in which only petitioner-3 was declared successful and petitioners-2 & 3 were declared unsuccessful.
The petitioners' want to cancel the said examination only on the ground that questions from UPTET-2017 examination have been repeated and only on the ground of repetition of question in UPTET-2021, the examination cannot be cancelled even otherwise the examination was held in January, 2022, in which only one petitioner was declared successful.
I do not find any good ground to interfere with the matter.
The writ petition lacks merit and is, accordingly, dismissed. No order as to costs.
