Heard Shri Onkar Nath Rai, learned Counsel for the petitioner, learned Standing Counsel for the respondent no.1, Shri Anil Kumar Bajpai, learned Counsel for respondent nos.4, Shri M.K. Mishra, Advocate holding brief of Shri Ras Bihari Pradhan, learned Counsel for respondent no.2 & 3.

The instant writ petition under Article 226 of the Constitution of India has been filed for mandamus directing the respondents to release the interest amount for the period 30.06.2011 to 21.01.2021.

It is contended by learned Counsel for the petitioner that after death of her husband she claimed family pension, which was not credited in the account of the petitioner then she filed a claim petition before the State Public Service Tribunal, Lucknow, which was subsequently dismissed as withdrawn.

It is further contended by learned Counsel for the petitioner that the amount of pension was credited in the year 2021 in the petitioner's account, which was with the respondent no.4, Bank but the same was deposited in the wrong account due to some fault of the educational authorities.

Lastly it is contended by learned Counsel for the petitioner that she submitted a detailed representation on 09.11.2021 before the respondent nos.3 & 4, Finance and Account Officer, Basic Education, District Ghazipur as well as Branch Manager, Union Bank of India, Branch Mardah, District Ghazipur, which has not been decided till date.

Learned Standing Counsel states that no useful purpose will be served in calling for the counter affidavit and keeping the writ petition pending and an appropriate direction may be issued to the respondent nos.3 & 4 to consider the grievance of the petitioner within stipulated period.

Considering the facts and circumstances of the case, without going into its merit and with the consent of the parties, the writ petition is disposed of with a direction to the respondent nos. 3 & 4, Finance and Account Officer, Basic Education, District Ghazipur as well as Branch Manager, Union Bank of India, Branch Mardah, District Ghazipur to decide the representation dated 09.11.2021 expeditiously, in accordance with law, by a reasoned and speaking order, preferably within a period of six weeks from the date of production of a certified copy of this order.
