Heard Mohd. Arshad learned counsel for the petitioner, learned Standing Counsel for the respondent-1, Sri Bipin Bihari Pandey, learned counsel for the respondents-2 & 3 and perused the record.

Present writ petition under Article 226 of the Constitution has been filed for direction to the respondent no.2-Basic Education Board, U.P. at Allahabad to transfer the petitioner from District Maharajganj to District Ghaziabad pursuant to Government Order dated 21.2.2019.

Learned counsel for the respondents-2 & 3 on the basis of instruction received from District Basic Education Officer, Maharajganj dated 13.4.2022 submitted that earlier the petitioner applied for inter-district transfer and since she was not completed five years of continuous service, her request was refused. Subsequently, the petitioner again applied for interdistrict transfer vide application dated 25.03.2021 stating therein that she has completed continuous service of five years on 21.03.2021 which as per the explanation 2 & 3 is not possible as the application was not invited by Basic Shiksha Parishad for inter-district transfer and when the application in this regard is invited in future, the petitioner is free to apply for the same and then her inter-district transfer shall be considered.

Learned counsel for the petitioner submits that in these circumstances, the writ petition may be decided on the aforesaid ground.

The writ petition, is accordingly, disposed of with direction when Basic Shiksha Parishad invites application for interdistrict transfer and the petitioner apply for the same, the same shall be considered, in accordance with law.
