Heard Shri Ramesh Kumar Singh, Advocate, holding brief of Shri B. Dayal, the learned counsel for the revisionists and Shri Sanjay Kumar Singh, the learned A.G.A. for the State.
This revision has been filed challenging the order dated 23.01.1990 passed by the court of learned A.C.J.M.-IInd, Agra in Case No. 1280 of 1990, summoning the revisionists to face trial under Sections 420, 406 I.P.C.
Learned counsel for the revisionists could not point out any illegality or infirmity in summoning the revisionists.
Learned A.G.A. submits that the present revision is of the year, 1990. Moreover, there appears no illegality or infirmity in the impugned order passed by the trial court, therefore, the present revision may be dismissed.
I have gone through the impugned order passed by the trial court and also perused the record. I have also considered the arguments advanced by the learned counsel for the parties. Learned counsel for the revisionists also could not point out any illegality or infirmity in the impugned order passed by the trial court.
In view of the above, after having gone through the order under challenge, this Court comes to the conclusion that the same needs no interference as there is no illegality or infirmity in the order under challenge, therefore, the present revision is liable to be dismissed.
Accordingly, the present revision is dismissed.
Interim order, if any, stands discharged.
Let a copy of this order be sent to the concerned District and Sessions Judge for its onwards transmission to the concerned Magistrate for compliance who will proceed further in the matter.
Let the lower court record, if any, be returned back to the court concerned.
The file is consigned to record.
