List has been revised. No one has appeared on behalf of the appellant to press this appeal, however, learned AGA for the State is present.
Chief Judicial Magistrate, Etawah vide his letter dated 02.11.2021 has informed this Court that sole appellant Nirakar has been murdered on 27.02.2019, in respect of which, FIR has been lodged by one Maya Narayan Chaudhary, cousin of the appellant. The FIR and GD report of registration of the case has been annexed. The statement of Gram Pradhan Rashmi Devi has been recorded. The report of SSI Vinod Kumar, Police Station Jaswant Nagar, District Etawah has also been annexed.
In view of the above, since the sole appellant Nirakar has already been done to death and in respect of which, FIR has also been registered, this criminal appeal is dismissed as abated.
