Chief Judicial Magistrate, Moradabad, vide his letter dated 29.11.2021 has informed this Court that the sole appellant, Balbir Singh Yadav had already expired on 9.5.2005.
In verification of his death, the statement of Brijpal Singh brother of the deceased has been recorded. The statement of Ran veer Singh, Gram Pradhan has also been recorded. The statement of S.I. Uttam Kumar has also been annexed.
In view of above, since the sole appellant had already expired, this Criminal Appeal is dismissed as having been abated.
