Chief Judicial Magistrate, Etah, vide his letter dated 22.10.2021 has informed this Court that the appellant No. 1, Wahid, appellant no.2, Bittan had already expired on 25.3.2018 and 18.3.2020 respectively.
In verification of their death, the statement of Abu Bakar son of the appellant no. 1 Wahid and Jafrul Khan cousin brother of the deceased has been recorded.
In verification of death of appellant no. 2 Bittan, the statement of Tauheed Alam Khan son of the deceased and Guljaman Khan brother of the deceased has been recorded. The statement of village Pradhan has also been recorded. Death certificate issued by State of U.P has also been annexed.
In view of above, since both the appellants had already expired, this Criminal Appeal is dismissed as having been abated.
