Heard learned counsel for the appellant, learned AGA for the State and perused the record.
Learned counsel for the appellant has made a statement at the Bar that after completing the period of sentence of five years, the appellant has already been released from District Jail, Bijnor.
In paragraph- 6 of the supplementary affidavit filed today, learned counsel for the appellant has categorically stated that the appellant does not want to further challenge the stigma of conviction and infraction and as such, the appeal may be dismissed as the appellant has already been released after completing the sentence awarded to him.
In view of the above since the appellant do not further intend to challenge the stigma of conviction and infraction pursuant to the conviction and seeks the instant appeal to be dismissed, the instant criminal appeal is dismissed in terms of the order under challenge.
