The present bail application has been filed on behalf of applicants Udham Singh, Smt. Reeta Saini and Gaurav Goel under Section 438 of the Code of Criminal Procedure, with a prayer to release them on anticipatory bail in Case Crime No. 70 of 2020, for offence punishable under Sections 406, 420, 467, 468, 471 of the Indian Penal Code, registered at Police Station- Gagalhedi, District, Saharanpur, till the conclusion of the trial.
This anticipatory bail application has been directly filed before this court under Section 438 Cr.P.C without approaching the court below.
After some arguments, learned counsel for the applicants wants to withdraw the application with liberty to file a regular bail application before the court of competent jurisdiction.
In view of the above, the application is dismissed as withdrawn with the aforesaid liberty.
