Sri Deepak Kumar Tripathi, learned counsel for the applicant and learned A.G.A. for the State are present.
The present bail application has been filed on behalf of applicant Jahageer under Section 438 of the Code of Criminal Procedure, with a prayer to release him on anticipatory bail in Case Crime No. 864 of 2009, for offence punishable under Sections 307, 394, 411 of the Indian Penal Code, registered at Police Station- Bakhira, District, Sant Kabir Nagar, till the conclusion of the trial, after rejecting the anticipatory bail application of the applicant by Additional Sessions Judge Court No. 1, Sant Kabir Nagar, vide order dated 11.02.2022.
Learned counsel for the applicant wants to withdraw the application with liberty to file a regular bail application before the court of competent jurisdiction.
In view of the above, the application is dismissed as withdrawn with the aforesaid liberty.
