Heard Sri Ravi Pandey, learned counsel for the applicant and learned A.G.A. for the State and perused the material on record.
The present anticipatory bail application has been filed on behalf of applicant Ayub under Section 438 of the Code of Criminal Procedure, with a prayer grant anticipatory bail in Case Crime No. 0054 of 2022, for offence punishable under Section 3/4 Public Gambling Act 1867, registered at Police Station- Kotwali, District- Moradabad, directly before this Court.
After some argument learned counsel for the applicant does not want to press the present anticipatory bail application.
Hence, anticipatory bail application is dismissed as withdrawn with liberty to file appropriate bail application before the Court of competent jurisdiction.
