Heard Sri Mohd. Samiuzzaman Khan, learned counsel for the petitioner and Sri Piyush Shukla, learned Addl. Chief Standing Counsel for the State respondents.

The present writ petition has been filed seeking following relief:

"I. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent No.2 to pay entire retiral dues such as gratuity, G.P.F., Group Insurance, Amount of Leave Encashment, Arear of pay fixation and Grade and other dues alongwith 18% interest therein in favour of the petitioner.

II. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent No.2 to consider and decide the representation of the petitioner dated 20.03.2020 within stipulated period at an early date as may be fixed by this Hon'ble Court."

Learned counsel for the petitioner submits that the petitioner retired on 31.09.2016 after attaining the age of superannuation. He contends that the retiral dues of the petitioner has not been paid till date and in this regard he has made a representation on 29.05.2020 before the respondent no.4, which is annexed as Annexure-5 to the writ petition. He further submits that the pending representation may be decided at the earliest.

Learned Standing Counsel submits that the claim of the petitioner shall be examined and appropriate orders shall be passed in the pending representation within a stipulated time.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is disposed of with the direction to the respondent no. 4 to consider and decide the representation of the petitioner dated 29.05.2020, in accordance with law within a period of two months from the date of presentation of a copy of this order.
