This petition has been preferred by the petitioner for payment of salary for the period 18 January 2016 to 20 May 2016 in respect of services rendered by her as a Consultant Doctor at the district hospital Noida. The petitioner after attaining the age of superannuation appears to have been granted re-employment in terms of the order dated 18 January 2016. Aggrieved by the fact that she had not been paid any emoluments during the period of the employment, she had preferred an earlier writ petition being Writ-A No. 7476 of 2018 which was disposed of with a direction to the respondents therein to take a decision with respect to the claim of the petitioner. The claim appears to have been rejected by the order dated 24 July 2018 with the second respondent taking the position that the petitioner had voluntarily and in public interest offered her services and therefore, no emoluments were payable. However before this Court attention is drawn to clause-3 of the order of re-employment which clearly envisages payment of emoluments to the petitioner for the period of re-employment.
