Heard learned counsel for the petitioners and Sri S.K.S. Kushwaha, learned counsel holding brief of Sri Kailash Singh Kushwaha, who appears for the Commission.
This petition has been preferred for consideration of the claim of the petitioners on the post of Village Development Officer. The dispute itself appears to have been arisen on account of certificates which are relied upon by the petitioners all of whom are Ex Servicemen and have placed their candidature on the strength of certificates showing knowledge and proficiency in computers. The Commission had initially taken the position that it was only a CCC Certificate issued by NIELIT or any institute accredited to it which would be entitled to be accepted. However, learned counsel has additionally drawn the attention of the Court to the Government Order dated 5 July 2018 to submit that the State itself has taken the view that other computer certificates including those held by candidates who may have graduated with Computer as a subject would also be entitled to be considered. He has also invited the attention of the Court to the communication of the Commission dated 18 February 2019 to contend that it has itself taken the view that certificates issued by institutes having an affiliation with the Department of Defence, are also liable to be accepted.
In view of the above position, the ends of justice would merit
the second respondent being requested to consider the validity of the testimonials submitted by all the petitioners here and to communicate a final decision with respect to their eligibility within a stipulated time frame.
Sri Kushwaha, learned counsel appearing for the Commission states that subject to all the 9 petitioners filing individual representations before the Secretary of the Commission along with all requisite testimonials within a period of 10 days from today, a decision with respect to their eligibility, shall be duly communicated to the petitioners within a period of two weeks therefrom.
Accordingly, this petition shall stand disposed of in light of the statement made by Sri Kushwaha and noted above.
