the District Magistrate and on the basis of said report, the ADM (F&R), Jaunpur has passed an order on 9.6.2008 directing to delete the name of aforesaid persons from Gata No. 138. It appears, thereafter, Shree Bhuyal, Siya Ram, Ruchi and others have preferred a Restoration/Recall application along with Delay Condonation Application before the authority concerned. Thereafter, the Case No. 179 (Raj Sarkar Vs. Siya Ram), under Section 33/39 of U.P.Z.A & L.R. Act was instituted. Consequently, the competent authority vide order dated 30.3.2013 has condoned the delay and recalled the order dated 9.6.2008. Thereafter, the case was forwarded to the court of SDM, Mariyahun. The said court after obtaining the document regarding the dispute in question and perusing the order dated 25.8.2015 passed in Case No. T-20151436062733, under Section 33/39 of L.R.Act, found that in the khatauni of 1359 fasli as well as 1356 fasli, the name of Omkar Nath, Sahab Nath, Parmatma Lal sons of Jagannath were mentioned for the period of 8 years as well as 5 years. The tenure holder, namely, Omkar Nath, Sahab Nath, Parmatma Lal sold the disputed land through sale deed dated 13.8.1963 to Hetai, son of Dasu Yadav, resident of Umram. Finally, the SDM, Mariyahun has passed an order on 25.8.2015 by which the entry made in the revenue record has been expunged and directed to enter the name of Siya Ram, Bhual, Ruchi sons of Hitai, Raj Kumar and Om Prakash sons of Jai Ram, Rajdei wife of Jai Ram, residence of Umram were recorded as 'Sankramaniye Bhumidhar'. The said order has been complied with and the name of aforesaid persons have been entered in the revenue record.
