No one appears on behalf of the applicant in the revised call.

This Contempt Application has been filed alleging wilful disobedience of the interim order dated 6.2.2014 passed by this Court in Writ Petition No.6973 of 2014 filed by the applicant wherein the Court directed as under:-

"As an interim measure, without prejudice to right and contention of the parties, the operation of the order dated 29.1.2014 passed by the Sub Divisional Officer, Jaunpur in case no. 517 (Raj Nath Vs. Shyam Narain) filed under section 176/177 of the Act shall remain stayed till the next date of listing and the earlier order passed by the Sub Divisional Officer, maintaining the status quo, shall continue. However, proceeding of the suit may go on, without being influenced by the interim order passed today and pendency of the writ petition till the next date of listing."

Initially, the present contempt application was taken up on 24.2.2014 and on the said date notices were issued to the opposite parties.

In pursuance of the aforesaid order dated 24.2.2014, detailed counter affidavit/affidavit of compliance was filed by the opposite party no.1 in the year 2014 to which no objection/rejoinder affidavit has been filed by the applicant. In the aforesaid counter affidavit it has been indicated that at no point of time the aforesaid interim order has been flouted by the opposite party no.1 and the writ petition has been dismissed for want of prosecution on 27.3.2017.

Consequently nothing further survives and the application is disposed of. Notices are discharged.
