Heard learned counsel for parties and learned Standing Counsel for Staterespondents.

This intra-Court appeal under Chapter VIII Rule 5 of Allahabad High Court Rules has arisen from the judgement dated 18.5.2018 passed by learned Single Judge, deciding 40 writ petitions in First-Set, and 26 writ petitions in Second-Set by a common judgement including appellants' Writ Petition No. 62082 of 2017 which is at Serial No.49 of the judgement. All writ petitions have been dismissed by learned Single Judge.

Against this very judgement, Special Appeal No. 605 of 2018 (Janardan Rai and 304 others vs. State of U.P. and 3 Others) arising out of Writ Petition No. 22142 of 2011 which was leading writ petition and is at serial no. 1 of judgement of learned Single Judge, was filed. After considering the judgement of learned Single Judge, Division Bench dismissed appeal vide judgement dated 4.7.2018.

We are informed that matter was taken to Supreme Court also in Special Leave to Appeal (Civil) No. 28338 of 2018 and Supreme Court vide judgement dated 12.11.2018 dismissed appeal. Judgement of Supreme Court reads as under :-

"Heard.

We are not inclined to interfere with the impugned order(s) in exercise of our jurisdiction under Article 136 of the Constitution of India.

The Special leave petition are accordingly, dismissed.

However, dismissal of these special leave petitions will not be an impediment for the petitioners to make representation before the appropriate authority / State Government and the same shall be considered on its own merits."

Since, judgement of learned Single Judge has attained finality up to Supreme Court, therefore, for the reasons stated in Division Bench judgement of this Court in Janardan Rai and 304 others vs. State of U.P. and 3 others, (Special Appeal No. 605 of 2018) decided on 4.7.2018, and order of Supreme Court dated 12.11.2018 as noted above and in the same terms, this appeal is dismissed.
