Heard Sri Vinod Kumar Shukla, learned Counsel for the petitioner, learned Standing Counsel for the respondents.

Briefly stated the facts of the case are that there is a temple known as Shree Ram Chandra Ji Maharaj Mandir/ Thakur Ji Maharaj Mandir situated in Village-Bilsanda, Tehsil-Bisalpur, District- Pilibhit having its Gata No. 59 area 0.7130 hectare and village Barhepura Marauri, Tehsil-Bisalpur, District-Pilibhit having its Gata No.225 area 0.1580 hectare, Gata No.249/301 area 0.1250 hectare and Gata No.214 area 0.3000 hectare for a long time. The petitioner no.2, Sadhvi Radhika Nand Giri became the Mahant/Sarvakar of the said temple and is doing Pooja Archana and also looking after the management. It is also stated that she first joined the Vaishno/Udaseen Akhara and later on she joined the Juna Akhara in the year 2016. The petitioner is apprehending threat to her life and therefore, she submitted an application before the S.D.M. Bisalpur, Pilibhit on 24.09.2018, annexure no.7, to the writ petition requesting that the temple may be taken over by the Government forming a Government Trust to provide protection and look after the management of the temple. In our opinion this matter can best be considered by the respondent no.2, District Magistrate/Collector District Pilibhit.

The writ petition is disposed of with a direction that if the petitioner prefers a fresh representation before the District Magistrate/Collector District Pilibhit, respondent no.2, within 15 days from today, in the light of the facts as disclosed in her earlier application dated 24.09.2018, alongwith certified copy of this order, the respondent no.2, District Magistrate shall consider and decide the said application in accordance with law within a further period of 3 months.

It is made clear this court has not adjudicated the claim of the petitioner on merit.
