Heard Sri Ashok Khare, learned senior counsel for the petitioners, learned standing counsel for respondent Nos. 1 & 2 and Sri G.K. Singh, learned senior counsel assisted by Sri H.P. Sahi for respondent No. 3.
The order impugned dated 21.4.2018 has been passed by the Assistant Registrar, Firms, Societies and Chits, Allahabad whereby, he has registered the list of Committee of Management of Maharishi Dayanand Vidyalaya Samiti, Manauri, Kaushambi for the year 2018-19.
Learned counsel for the petitioners submitted that the dispute relating to earlier election, as well as the election on basis of which the Deputy Registrar has now passed the impugned order, is under consideration by the Regional Level Committee in pursuance of the order of this Court dated 5.3.2018 in Writ C No. 8319 of 2018. It is urged that in such circumstances, the Deputy Registrar ought not to have registered the list of office bearers.
After some argument, counsel for the petitioners prayed for liberty to challenge the election dated 18.2.2018 on basis of which impugned order has been passed by seeking a reference to the Prescribed Authority under Section 25(1) of the Act.
Accordingly, the instant writ petition is permitted to be withdrawn, with liberty aforesaid reserved in favour of the
petitioners.
The petition stands disposed of as above.
