Heard learned counsel for the petitioner; Sri Mrigraj Singh for the respondents 2; the learned Standing Counsel for the respondent no.1; and perused the record.

The present petition has been filed for a direction upon the second respondent to consider the prayer of the petitioner in respect of attestation of signature as Manager of the institution.

From the document appended at page 36, it appears that earlier one Babu Ram Prajapati was Manager of the institution against whom a no confidence resolution was allegedly passed and the list of office-bearers was submitted before the Assistant Registrar, upon which, he had issued a notice on 27.09.2017 to the erstwhile Manager.

It has not been stated in the writ petition as to what decision has been taken by the Assistant Registrar in respect of list of office-bearers submitted before him. Moreover, the Assistant Registrar is not a party.

Under the circumstances, without expressing any opinion on the merits of the claim of the petitioner, this Court considers it appropriate to dispose of this petition by giving liberty to the petitioner to represent his cause before the Basic Shiksha Adhikari, Jaunpur who shall examine the claim of the petitioner in accordance with law, after verifying the facts from the office of the Assistant Registrar concerned, as also after providing opportunity of hearing to the persons concerned.

With the aforesaid observation/liberty, the petition is disposed of .
