The present petition has been filed for a direction upon the second respondent to consider the prayer of the petitioners for registering the list of office bearers of Maharshi Dayanand Sansthan within a stipulated period.
Whether already a list of office bearers of the concerned society has been registered or not is not disclosed in the writ petition but Sri R.V. Mishra, who has put in appearance on behalf of one Pankaj Jaiswal, who claims himself to be the Manager of the Society, states that a list of office bearers of the Society has already been registered and therefore the prayer made by the petitioners cannot be accepted.
Be that as it may, this petition is disposed of with liberty to the petitioners to move a comprehensive representation before the second respondent in respect of his grievance. If any such representation is filed along with certified copy of this order, the second respondent shall first ascertain whether any list of office bearers of the concerned Society for the concerned year has already been registered or not. If it finds that the list of office bearers of the society has not yet been registered, then the prayer of the petitioners shall be considered in accordance with law. In case already a list of office bearers of the Society has been registered, then the petitioners would have liberty to challenge the said registration before appropriate forum.
It is made clear that this Court has not expressed any opinion on the merits of the claim of either party.
