Heard Sri Ratnesh Kumar Singh, learned counsel for the petitioner, learned Standing Counsel for respondent nos. 1 and 2 and Sri S.K. Rai, learned counsel appearing for respondent nos. 3,4 and 5.

The petitioner in the writ petition is seeking quashing of the order dated 26.7.2018, whereby, he has been dismissed from service by the Secretary & Chief Executive Officer, District Cooperative Bank Limited, Banda.

A preliminary objection has been raised by the learned counsel for the respondents that against the order of dismissal, the petitioner has a statutory remedy of approaching the respondent no.2-Commissioner & Registrar, Co-operative Societies, U.P., Lucknow under Section 128 of the U.P. Co-operative Societies Act, 1965.

Learned counsel for the petitioner then prayed that the petitioner may be granted some time to prefer a representation before the respondent no.2 against the dismissal order.

We, therefore, dispose of this writ petition with a direction that if the petitioner prefers a representation before the respondent no.2-Commissioner & Registrar, Co-operative Societies, U.P, Lucknow in respect of his grievance as raised in this writ petition along with a certified copy of this order within a period of fifteen days from today, the respondent no.2 shall consider and decide the said representation in accordance with law within a period of three months thereafter.

It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
