Heard learned counsel for the revisionist, learned A.G.A for the State and Sri M.N. Shukla, learned counsel for the opposite party No.2 as also perused the record.

The revisionist has approached this Court against the order dated 05.10.2018 passed by Principal Judge, Family Court, Shamli, in Case No. 1607/11 of 2014, under Section 125 of Cr.P.C., Police Station Kandhala, District Shamli.

Submission is that interim maintenance has been directed to be paid from the date of application. It has further been submitted that the proceedings under Section 125 Cr.P.C. is yet to be decided finally and without recording final order, the direction for payment of interim maintenance from the date of application is not justified. The applicant is directed to make payment of interim maintenance to the opposite party No.2 from the date of order till the date of decision of application under Section 125 Cr.P.C.

This revision is disposed of with a direction to the court below to conclude the trial under Section 125 Cr.P.C. in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of three months from the date of production of a certified copy of this order, if there is no other legal impediment.

The observations made in this case shall be come in the way of court below in deciding the application of interim maintenance on the basis of evidence led by the parties.
