Court No. - 45
Case :- CRIMINAL REVISION No. - 1487 of 1991
Revisionist :- Kamruddin Opposite Party :- State Counsel for Revisionist :- S.A. Shah Counsel for Opposite Party :- A.G.A.
Hon'ble Siddharth,J.
As per the office report dated 30.11.2018, service of notice to engage another counsel on the revisionist is deemed sufficient.
None appears on behalf of the revisionist even in the revised call. Heard learned A.G.A. for the State.
This revision is directed against the order dated 26.7.1991 passed by the VIIIth Additional Session Judge, Bulandshahr in Criminal Appeal No.63 of 1988, whereby the order dated 14.3.1988 passed by the IInd Additional Munsif Magistrate, Bulandshahr in Criminal Case No.167 of 1988 was affirmed and the appeal of the revisionist for release of his tractor was dismissed.
The finding recorded in the order is that the applicant failed to bring on record any credible evidence regarding his ownership of the disputed tractor. Since even after service of notice the revisionist is not appearing, it appears that he is not interest in pressing this revision for release of his tractor.
Revision is, accordingly, dismissed.
Office is directed to communicate this order to the court concerned within a period of two weeks.
