The revision is filed against the order dated 18.03.1991 directing the framing of charges against the accused under Section 420 I.P.C. The Revisional Court below has set aside the same by the order dated 09.10.1991. Aggrieved by the same, this revision has been preferred. As yet, no notices have been issued in this case. A perusal of the order of the learned Revisional Court below shows that the dispute was regarding mutation entries. The Court below has recorded the finding that at the relevant time the dispute regarding the genuineness of the entries was pending before the Sub Divisional Magistrate, and after conclusion of proceedings only it could have been conclusively said whether the act of the accused was justified or not and whether any criminal offence against him is made out or not. Final report was also submitted in favour of the accused in this case. The Court below has found that no offence under Section 420 I.P.C. is made out against the accused and has therefore, held that charge under the aforesaid Section is not made out against him. The order of Court below appears to be justified and calls for interference. This revision fails and is accordingly dismissed .
