Petitioner is serving as Lecturer in Government Inter College, Shailanigoth, District Champawat. Vide order dated 25.6.2019, he was transferred from Government Inter College, Shailanigoth to Government Inter College, Dyuri, District Champawat, against a vacant post. Challenging his transfer, this writ petition was filed by the petitioner in 2019. A coordinate Bench of this Court, vide order dated 27.11.2019, stayed the effect and operation of the impugned transfer order. Pursuant to the said interim order, petitioner is still continuing in Government Inter College, Shailanigoth. Considering that petitioner has been transferred from one institution to another in the same district and on the strength of the interim order alone, petitioner continued to serve at Shailanigoth for nearly three years and earlier also, he was posted there since a considerable period of time, and transfer being condition of service, this Court is not inclined to examine the alleged illegality committed in passing the impugned transfer order at this belated stage. Consequently, writ petition is dismissed. Interim order dated 27.11.2019 is vacated.
