This is first bail application moved by the applicant who is in jail in connection with FIR No. 57 of 2021, offences punishable under Sections 307, 325, 504, 506 & 34 IPC, registered at PS Pantnagar, District Udham Singh Nagar. Heard learned counsel for the parties and considered the grounds taken up in the bail application. Learned counsel for the applicant submits that applicant has falsely been implicated in the instant crime; has no previous criminal history and is languishing in jail since 31.05.2021. He further submits that according the FIR, on the date of alleged incident, victim suddenly met with the accused persons and only thereafter, the alleged incident have been took place between the parties, therefore, there was no intention or knowledge to commit such offence. Furthermore, the FIR is delayed one; inasmuch as there is a delay of two days. He also submits that no specific role has been assigned to the applicant.
