			Mr. Mani Kumar, learned counsel holding brief of Mr. Matloob Rawat, learned counsel for the applicant. Mr. K.S. Rawal, learned A.G.A. for the State of Uttarakhand. This is first bail application moved on behalf of the applicant seeking regular bail in connection with FIR No. 52 of 2021 for the offence punishable under Sections 8/ 20 of N.D.P.S. Act registered at P.S. Nanakmatta, District- Udham Singh Nagar. Learned counsel for the applicant submits that the applicant has falsely been implicated in the instant crime; has no criminal history and is languishing in jail since 21.3.2021. According to the learned counsel for the applicant, the quantity of Charas alleged to have been recovered from the applicant is 1 Kg, which is below the commercial quantity. Learned counsel for the applicant also submits that mandatory provisions of N.D.P.S. Act have not been complied with. Learned State Counsel admits that the applicant has no criminal history. Considering the facts and circumstances of the case, without expressing any opinion as to the final merits of the case, this Court is of the view that the applicant deserves bail at this stage. The bailapplication is allowed.
