The petitioner is a Junior Clerk in Uttarakhand Jal Sansthan. He claims promotion to the post of Accountant. For the post of Accountant, a written examination was conducted by the Department amongst the feeding cadre (including the petitioner). The petitioner case was that he has already given the written examination and already stands qualified. Therefore, he prayed that he

should be exempted to again appear in the written examination.

This contention of the petitioner cannot be accepted as per the interim order dated 26.05.2011 of this Court by which the petitioner was given liberty to appear in the written examination. According to the counsel for the petitioner, he submits that the petitioner appeared in the examination, however, the result has not been declared as yet.

It is an admitted position that the petitioner appeared in the written examination. In view thereof, the writ petition is disposed of with the direction to the respondents to declare the result of the petitioner and thereafter, promotion be made, in accordance with the existing Rules, so that the suitable candidate may be promoted.
