Even before opening the arguments by the learned counsel for the petitioner, learned Additional Advocate General Mr. V.B.S. Negi appearing on behalf of State in the matter has brought to the notice of this Court that vide order dated 02.12.2014 petitioner’s services have already been terminated.
According to learned counsel for the petitioner, he has no knowledge of this order but now since this order has been brought to his knowledge, he will challenge the same. Hence, he wants to withdraw this writ petition with liberty to file a fresh petition.
In view thereof, the writ petition is dismissed as withdrawn with liberty to file a fresh petition.
It is made clear that the dismissal of present writ petition will not prejudice the case of the petitioner, in case he files fresh writ petition, interalia, challenging the order of termination.
