The petitioner is an Office Assistant in Uttarakhand Power Corporation Ltd. He is aggrieved by order dated 26.09.2014, passed by the Superintending Engineer (Electricity Distribution Circle Rural) of the Corporation by which the earlier transfer order passed by the Superintending Engineer dated 22.08.2014 has been recalled. By order dated 22.08.2014, the petitioner was transferred from Electricity Distribution Sub Division, Vikas Nagar, Dehradun to Electricity Distribution Sub Division, Mohanpur, Prem Nagar, Dehradun. This Court, by an interim order dated 16.10.2014, stayed the order dated 26.09.2014.

An intervention application (CLMA No.12188 of 2041) has been moved by one Mr. Manoj Rawat, whose name also figures in the transfer order. It has also been pointed out that the petitioner has been working at Prem Nagar or Mohanpur, Dehradun since 2004, and for this reason the transfer has now been cancelled.

In view thereof, the writ petition is disposed of with the direction to the Chief Engineer, Uttarakhand Power Corporation Ltd., Dehradun who shall look into the matter afresh and consider the transfer of Mr. Roop Singh Khatri, Mr. Manoj Rawat and Mr. Sunil Tomar afresh, after calling for their written representations. It is made clear that no personal hearing is required in the matter, except a perusal of the written representations.

Let the Chief Engineer take an appropriate decision in the matter within a period of three weeks from today. Till a decision is taken by the Chief Engineer, status quo as on date shall be maintained.

Learned counsel for the Uttarakhand Power Corporation Ltd. Mr. Naresh Pant undertakes to inform about this order to the Chief Engineer for necessary compliance.
