The petitioner has an Arms licence from the State of Punjab. Thereafter, the petitioner came to the State of Uttarakhand and settled in District Udham Singh Nagar in Uttarakhand and sought for renewal of Arms licence before the District Magistrate, Udham Singh Nagar.

This is being denied to the petitioner by the District Magistrate concerned on the basis of the instruction of the State Government Order dated 27.11.2012 whereby the armed licence issued by the neighbouring State of Himachal Pradesh and Uttar Pradesh can only be renewed in the State of Uttarakhand.

Yesterday learned counsel for the petitioner made a statement at bar that in another writ petition, which is having similar facts, a counter affidavit has been filed by the State Government wherein it has been stated that the Government Order dated 27.11.2012 has been withdrawn by the State Government. Therefore, today this matter is being listed along with WPMS No. 372 of 2013.

District Magistrate – Brijesh Kumar Sant by way of an affidavit that the order dated 27.11.2012 has been cancelled and therefore, the order of the SSP lost its significance.

Since no counter affidavit has been filed in the present matter, therefore, taking note of the counter affidavit filed in the connected writ petition, the writ petition is disposed of with the direction to the District Magistrate, Udham Singh Nagar to decide the application of the petitioner, in accordance with law, within a period of six weeks from the date of production of a certified copy of this order.
