This is an application seeking regular bail in Case Crime / FIR No. 299 of 2013 under Section 304-B IPC, Police Station Kashipur, District Udham Singh Nagar.
Mr. Abhishek Verma, learned counsel, appearing for the applicant, while referring to the FIR submits that as per the contents of the FIR Suman was killed because her husband Manoj Kumar was having illicit relations with another lady. Mr. Abhishek Verma further contends that in view of the contents of the FIR, on the face of it, present case is not of dowry death; there is no direct, last seen or extra judicial confessional evidence against the applicant; applicant is old lady; even minor children have been falsely implicated in the present case.
Considering the totality of the facts and circumstances of the case. Bail application is allowed. I direct, let the accused/applicant be released on bail on furnishing her personal bond of `50,000/- and two sureties of like amount, to the satisfaction of learned Additional Chief Judicial Magistrate, Kashipur.
