This is a 1st bail application seeking regular bail in Case Crime No. 1 of 2013, under Sections 376/511 and 506 I.P.C., Patti Patwari Devdar, District Nainital.
Learned counsel for the applicant submits that story of prosecution that prosecutrix was caught and was pulled down on the road and, thereafter, tried to be rapped on the face of it seems to be improbable. He further submits that the applicant is in jail since 19/03/2013.
Considering the totality of the facts and circumstances of the case, I direct, let the accused/applicant be released on bail on furnishing a personal bond of Rs.50,000/- and two sureties of like amount to the satisfaction of learned Magistrate concerned.
Bail application stands allowed accordingly.
