This is a 1st bail application seeking regular bail in Case Crime No. 47 of 2012, under Sections 363, 366 and 376 I.P.C., P.S. Bharonjkhan, District Almora.
Learned counsel for the applicant submits that as per medical report filed alongwith supplementary affidavit, age of prosecutrix was 15-17 years and she was found pregnant and habitual of intercourse; prosecutrix in her statement on oath, while appearing as PW2 stated that applicant did not commit any rape; prosecutrix was never kidnapped and abducted by the applicant.
Considering the totality of the facts and circumstances of the case, I direct, let the accused/applicant be released on bail on furnishing a personal bond of Rs.50,000/- and two sureties of like amount to the satisfaction of learned trial court.
Bail application stands allowed accordingly.
