This is a 1st bail application seeking regular bail in Case Crime No. 163 of 2012, under Sections 395 and 201I.P.C., P.S. Bhagwanpur, District Haridwar.
Learned counsel for the applicant submits that applicant has been implicated in the present case on the basis of confessional statement of the co-accused, namely, Khilafat; no recovery was ever made either from the possession of the applicant or on the pointing out of the applicant; while placing reliance on the judgment of Hon’ble Apex Court in the case of State of Kerala Vs. Raneef reported in 2011 (1) SCC, 784 , learned counsel argued that if bail is declined and ultimately accused/applicant is acquitted, the time spent by the applicant in jail cannot be restored to him.
Considering the totality of the facts and circumstances of the case, I direct, let the accused/applicant be released on bail on furnishing a personal bond of Rs.50,000/- and two sureties of like amount to the satisfaction of learned A.C.J.M., Roorkee.
Bail application stands allowed accordingly.
