This is a 1st bail application seeking regular bail in Case Crime No. 253 of 2012, under Sections 307 and 120-B I.P.C. P.S. Kankhal, District Haridwar.
Learned counsel for the applicant submits that shot was attributed to co-accused Chandan alias Raju; applicant has been implicated in the present case on the confessional statement of coaccused; confessional statement made by co-accused cannot be made basis for conviction of the applicant.
Considering the totality of the facts and circumstances of the case, I direct, let the accused/applicant be released on bail on furnishing a personal bond of Rs.50,000/- and two sureties of like amount to the satisfaction of learned C.J.M., Haridwar.
Bail application stands allowed accordingly.
