Today, when the matter is taken up for hearing, learned counsel for the petitioner submits that after filing this writ petition, the respondent authorities have completed formation of road without disturbing the possession of the petitioner's property and the petitioner also obtained permission from the respondent No.3 for construction of the building. In vieu, the same, the cause in this writ petition does not survive for adjudication and requested to grant liberty to the petitioner to challenge before appropriate authority, if the respondents interfere with the possession of the petitioner's property.

2, Recording the said submission, the writ petition is closed granting liberty as prayed for. There shall be no order as to costs.
